1. Acceptance of Terms

By downloading, installing, or using the CaseTrack+ mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Operator: The App is operated by D&B Evergreen Adventure LLC.

2. Description of Service

CaseTrack+ provides the following services:

• Case status checking by querying the official USCIS case status API
• Push notifications when case status changes
• Local storage of your saved cases on your device
• Display of USCIS news from official RSS feeds
• Access to visa bulletin information
• USCIS forms library and fee information
• Civil surgeon locator tool

3. User Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you must have permission from a parent or legal guardian.

4. User Responsibilities

4.1 Accurate Information

You are responsible for:

• Entering accurate USCIS receipt numbers
• Verifying information displayed by the App with official USCIS sources
• Not relying solely on the App for critical immigration decisions

4.2 Prohibited Uses

You agree NOT to:

• ❌ Use the App for any illegal purpose
• ❌ Attempt to reverse engineer, decompile, or hack the App
• ❌ Use automated systems or bots to query the App
• ❌ Overload or interfere with USCIS servers
• ❌ Misrepresent the App as an official USCIS service
• ❌ Violate any applicable laws or regulations
• ❌ Share or distribute the App in violation of its license

4.3 Account Security

While the App does not require account creation, you are responsible for:

• Keeping your device secure
• Not sharing your receipt numbers with unauthorized persons
• Protecting your backup files if you export data

5. Intellectual Property

5.1 Our Property

The App, including its design, code, graphics, and content (excluding USCIS data), is owned by D&B Evergreen Adventure LLC and protected by copyright, trademark, and other intellectual property laws.

5.2 USCIS Content

All USCIS case status information, forms, news, and visa bulletin data belongs to the U.S. government and is in the public domain. We do not claim ownership of this content.

5.3 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:

• Resell or redistribute the App
• Create derivative works based on the App
• Remove copyright or trademark notices

6. Disclaimers and Limitations

6.1 No Legal Advice

6.2 Information Accuracy

We strive to display accurate information from USCIS, but:

• We cannot guarantee the accuracy, completeness, or timeliness of USCIS data
• USCIS may have errors in their system
• There may be delays in status updates
• Technical issues may prevent data retrieval

6.3 No Guarantees

We do NOT guarantee:

• Uninterrupted or error-free operation
• That the App will meet your specific needs
• That defects will be corrected
• That USCIS servers will always be accessible
• That notifications will be delivered instantly

6.4 "AS IS" Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Limitation of Liability

7.1 No Liability for Immigration Consequences

We are NOT responsible for any immigration consequences resulting from your use of the App. This includes but is not limited to:

• Missed deadlines or appointments
• Denied applications
• Deportation or removal proceedings
• Financial losses
• Travel issues

7.2 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED $50 USD OR THE AMOUNT YOU PAID FOR THE APP (IF ANY), WHICHEVER IS GREATER.

7.3 Exclusion of Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless D&B Evergreen Adventure LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws

9. Third-Party Services

9.1 USCIS API

The App relies on the USCIS case status API. We are not responsible for:

• USCIS server downtime or errors
• Changes to USCIS API structure or availability
• USCIS's terms of service or privacy policies

9.2 Other Third-Party Services

The App may use:

• Push notification services (Apple, Google)
• Analytics services
• Advertising networks (Google AdMob)
• Map services for civil surgeon locator

These services have their own terms and privacy policies which you should review.

9.3 External Links

The App may contain links to external websites (including USCIS.gov). We are not responsible for the content, accuracy, or practices of these external sites.

10. Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we handle your information.

11. Advertising

The App may display advertisements. We reserve the right to:

• Display ads in various formats and locations
• Change ad frequency or placement
• Use third-party ad networks

You can opt out of personalized advertising through your device settings.

12. Updates and Modifications

We may update the App to:

You are responsible for keeping the App updated to the latest version.

Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Termination

You may stop using the App at any time by uninstalling it from your device.

13.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete the App from your device

14. Data Backup

You are solely responsible for backing up your saved cases and data. We recommend regularly exporting your data using the backup feature. We are not responsible for any data loss.

15. No Government Affiliation

This App is a private service and is not:

• An official USCIS application
• Endorsed or approved by USCIS
• A substitute for official USCIS services
• Able to influence immigration decisions

16. Geographic Restrictions

The App is designed for users interacting with USCIS, which is a U.S. government agency. While you can use the App from anywhere in the world, it is governed by U.S. law.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of law provisions. Any legal actions or proceedings arising under these Terms will be brought exclusively in the federal or state courts located in Washington State, and you hereby consent to personal jurisdiction and venue therein.

18. Dispute Resolution

18.1 Informal Resolution

Before filing a claim, you agree to contact us at support@usciscasechecker.com to attempt to resolve the dispute informally.

18.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

18.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and not as part of a class action, consolidated action, or representative action.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and D&B Evergreen Adventure LLC regarding the App and supersede all prior agreements.

21. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

22. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

23. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• USCIS system changes or downtime
• Natural disasters
• Government actions
• Internet service disruptions
• Pandemics or public health emergencies
